Privacy notice

How Atherton Forge collects, uses, shares, and protects the information and files you provide when you use this website or request a quote.

Draft for review by counsel. This document has not yet been reviewed by an attorney. Effective date: to be set on publication.

1. Who we are

This notice is issued by North Brookville LLC, a California limited liability company doing business as Atherton Forge (“Atherton Forge,” “we,” “us”). It applies to information collected through this website, the quote-request form, and email correspondence relating to it. Questions about this notice can be sent to legal@athertonforge.com.

2. Information we collect

Information you provide. When you request a quote or contact us, you provide contact details (name, company, business email), project information (stage, service, quantities, timeline, location preference, notes), and manufacturing files you choose to upload, such as fabrication data, bills of materials, drawings, firmware, and mechanical models.

Information collected automatically. Our hosting infrastructure records standard technical information about visits, such as IP address, browser type, pages requested, and timestamps, in server logs used for security and operation. [If analytics or similar tools are deployed on the live site, they are to be listed here with their purpose and the categories of data they process.]

3. How we use information

We use the information you provide to review your manufacturing package, respond with questions and findings, prepare quotes and production plans, put non-disclosure agreements in place when requested, and — if you proceed — coordinate manufacturing, sourcing, testing, and delivery. We also use information to communicate with you about your project, to maintain security and prevent misuse of the website, to keep records required by law, and to comply with export-control, sanctions, and other legal obligations.

We do not sell personal information, and we do not use your project files for any purpose other than reviewing, quoting, and building your project.

4. How we share information

We share information only as needed to serve your project and operate the business:

  • Selected manufacturing facilities and logistics providers working on your project receive the project files and instructions needed to quote and build it. The facility is confirmed with you before files are shared.
  • Service providers that host our website, deliver email, or store files process data on our behalf under contractual confidentiality obligations.
  • Legal requirements. We may disclose information when required by law, regulation, legal process, or governmental request, or to protect rights, safety, and property.
  • Business transfers. If the business is reorganized, sold, or merged, information may be transferred to the successor, subject to this notice.

5. Confidential files and NDAs

Manufacturing files are treated as confidential. Access is limited to the personnel reviewing your project and to the facilities selected to quote or build it. On request we will enter into a mutual non-disclosure agreement before you submit detailed files; the quote-request form includes this option, and you may submit project information without files until the agreement is in place. Your design and intellectual property remain yours; see the terms of use.

6. Retention

We retain project information and files for as long as needed to serve the project, to support repeat production of released designs, and to meet legal, accounting, and export-control record-keeping obligations. You may ask us to delete project files at any time; we will do so except where retention is required by law or by an active order, and we will confirm deletion in writing.

7. Security

We apply reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including access controls and encryption in transit. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. International transfers

Facilities in the qualified manufacturing network are located in the United States and Asia. Where a facility outside the United States is selected for your project, your project files and related contact information are transferred to it for the purpose of quoting and building your project. The facility and manufacturing origin are confirmed with you in writing before any transfer. Export-controlled technical data is subject to the separate export-control notice.

9. Your choices and rights

You may request access to, correction of, or deletion of your personal information, and you may ask us to stop contacting you, by emailing legal@athertonforge.com. We will verify your request and respond within the time required by applicable law.

California residents. The California Consumer Privacy Act, as amended, may give you rights to know what personal information we collect and how it is used and shared, to request deletion or correction, to opt out of the sale or sharing of personal information (we do not sell or share personal information for cross-context behavioral advertising), and not to be discriminated against for exercising these rights. Submit requests to the address above. Authorized agents may submit requests on your behalf with proof of authorization.

10. Children

This website is intended for businesses and is not directed to children under 16. We do not knowingly collect personal information from children.

11. Changes to this notice

We may update this notice from time to time. The effective date will be shown at the top of the notice, and material changes will be communicated to active project contacts by email.
